On February 16, 2010 a United States District Court Judge for the Western District of Texas gave final approval to a Class Action Settlement valued at approximately $22.0 million. The law firm served as co-counsel in the case since the case began in August of 1997. This case involved issues of sovereign immunity, Rehabilitation Act, and Americans with Disabilities Act. The settlement involves individual reimbursement and cy pres distributions. In its Order the Court remarked "the Court finds Plaintiffs' counsel competently represented Plaintiffs and achieved excellent results on their behalf. Class counsel financed this case, in time and expense, for 13 years. They were competent in the federal court, the state court, and in the courts of appeal, and they were extremely competent in settlement negotiations (as evidenced by the result of those negotiations)."

The law firm defended an elected city commissioner in an election challenge lawsuit filed by the unsuccessful candidate and some electors. The Court dismissed the lawsuit early into the litigation. This case involved issues of election laws, candidate qualifications and candidate eligibility.

The law firm successfully litigated a public records lawsuit against a Circuit Court Clerk and was judicially determined to be entitled to recover attorney's fees and costs, in an amount to be determined. This case involved issues of required production of public records, policy relative to the destruction of public records and law as to award of attorney fees.

Serving as co-counsel in a class action lawsuit filed against the State of Texas in August of 1997, the law firm is pleased to report on October 19, 2009 the Federal District Court granted preliminary approval to a Settlement Agreement reached between the parties. The Settlement Agreement is for the benefit of persons with permanent disabilities charged for blue parking placards or who would have been charged in the future. The settlement is valued in excess of $24.0 million.

The law firm, on behalf of a municipality, successfully argued for the full and complete dismissal of a Petition for a Writ of Mandamus filed by a property owner seeking a residential future land use designation for a 12 acre parcel of land. This case involved issues related to: the fundamentals of a Petition for Writ of Mandamus; future land use map amendments and challenges related thereto.

Each year the Colorado Trial Lawyers Association recognizes a case as having the most significant contribution to the State of Colorado. At its May 2009 meeting the Colorado Trial Lawyers Association awarded the 2008 case of the year to a case in which the law firm served as Co-counsel. The case involved issues related to: the Americans With Disabilities Act; sovereign immunity; and equal protection.

The law firm successfully defended an entity in trial wherein a municipality was pursuing the removal of a number of the entity's signs. The case involved issues related to: the interpretation of land development code provisions; and the constitutional prohibition of newly enacted laws creating an impairment to existing contracts.
